Hollywood Studios Sue Over DVD Ripping

Hollywood movie studios have filed a lawsuit against Real Networks over a business practice known as “rent, rip, and return.” This new technology, developed by Real Networks, allows individuals to go to a video store, rent a movie, loan the DVD into a computer and then burn a new copy of the DVD.

Hollywood movie studios are concerned that this practice violates copyrights and is going to cost them billions of dollars a year. This practice, the studios allege, is basically stealing.

Real Networds claims that the company just wants individuals to get full use of their DVDs by allowing owners to make backup copies of their DVDs.

Interestingly, the same United States District Judge in San Francisco that shut down the mp3 website Napster is hearing this case.

Lil' Wayne Sues Producer Over Unauthorized Sampling

The rapper Lil’ Wayne filed a lawsuit alleging that one of his producer’s sampled the work of a third party without permission.

The lawsuit was filed in response to a lawsuit filed against Lil’ Wayne accusing him of copyright infringement on the song “I Feel Like Dying.” The suit against Lil’ Wayne alleges that he sampled the song “Once” by folk musician Karma-Ann Swanepoel.

As a defense, Lil’ Wayne filed the lawsuit against his producer alleging that the producer was responsible for licensing agreements.

Suing to Protect "The Boys of Summer"

California Republican Senatorial Candidate Charles DeVore was sued by singer Don Henley, a founding member of the Eagles, over a campaign video that appeared on YouTube. Henley argues that DeVore used copyrighted material in the video. Specifically, DeVore used two of Henley’s songs, “The Boys of Summer,” and “All She Wants to do is Dance.”

The songs were used as a tool to attack DeVore’s opponent, United States Senator Barbara Boxer. DeVore, however, has not backed down from the suit. He filed a counter claim, arguing that the First Amendment’s protections of political speech authorize the use of Henley’s music.

YouTube originally removed the videos from its website, but later reposted them after DeVore challenged their removal. Subsequently, YouTube informed Henley that it would only remove the videos again, upon the filing of the lawsuit.

If you have had copyrighted material infringed upon, contact an attorney who will be able to assert your legal property rights in the material.
